Traumatic Brain & Spinal Injuries

Traumatic Brain Injuries

This type of injury is not very easy to prove in that many CTs and MRIs can show no evidence of internal bleeding in the brain when in fact the victim has suffered injury to the brain. The elements of a traumatic brain injury are basically that the tasks that we take for granted in getting us through the day, the analytical ability of each of us to do the things that we take for granted are severely or moderately effected in a traumatic brain injury case. The injury to the victim usually occurs where the victim’s head strikes the interior of a motor vehicle or from striking their head on a hard floor surface, a chair or other piece of furniture or from being struck in the head by a falling object. Most individuals who have suffered this type of injury usually go home the same day without going to the emergency room as they feel they’ve only suffered a minor concussion or just a minor blow to the head. That is usually utilized by the defense attorney to cast doubt upon whether or not the victim sustained a brain injury. However, because the inside of the skull has sharp protrusions that can cause injury to the brain in the frontal and temporal lobes when an individual’s head suffers a shock or strong shaking in a car it can result in a brain injury.

Common early symptoms of a brain injury are:

  • Dizziness
  • Loss of consciousness
  • Feeling dazed or confused
  • Retrograde amnesia or the accident details
  • Headache
  • Nausea and vomiting

Future brain injury can show symptoms of:

  • Depression
  • Inability to control anger and emotions
  • Loss of balance
  • Personality changes
  • Increased irritability
  • Loss of smell
  • Decreased hearing
  • Diminished concentration
  • Slurred speech
  • Slower thinking
  • Word-finding difficulties
  • Memory loss
It is the job of your attorney to gather all the witnesses who can substantiate how you have changed following suffering your brain injury as these are the witnesses who are most persuasive before a jury to show that you have suffered a brain injury and that your life has changed as a result of it.

Spine & Herniated Disc Injuries

One of the most common injuries in a motor vehicle collision is a spinal and/or herniated disc injury. This injury is commonly known as a slipped disc. A slipped disc will place pressure on the nerve. If it’s a lower back injury the nerve will run from your lower back to your foot. The pain can be manifested in the thigh or calf and be a dull ache indicating that there is pressure on the nerve from the slipped disc. Sometimes this can be treated without surgery or it can be treated with surgery if it’s very serious. Today many doctors shy away from surgery in that the risk involved can cause greater damages than what was sustained in the motor vehicle accident. Of course, every case is different. If you have sustained a spinal or herniated disc injury as a result of being in an accident then it is essential to see an attorney as soon as possible so that we can adequately document all of your injuries and review your past medical history as well inasmuch as the insurance company, more often than not, will try to blame you for having a pre-existing injury that you are now claiming was caused by this recent accident and this is where Mr. Kaydouh’s experience comes in, in that it is necessary to obtain all of your records from the date of the accident and before the accident so as to prove to the satisfaction of the insurance company and a jury if necessary that your recent injury is a fresh injury and new to the case.

Bone Fractures

Broken bones are a serious injury which often cause serious complications or can cause permanent disabilities. An individual can break a bone from the force of a motor vehicle accident, from a fall on a hard surface. Most bone fractures will heal but sometimes, if the fracture is severe, the bone may not heal properly and may cause permanent disability. Sometimes a bone fracture is so severe that surgery may be needed and sometime pins are required to reset the bone properly. Usually when one falls and lands oddly on their arms or their legs they will experience pain. If the pain is accompanied by any of these symptoms it most likely means that there is a fractured bone:
  • Extreme pain
  • Swelling
  • Bruising
  • Bleeding
  • Deformity
  • Inability to move.
A severely broken bone can result in traumatic arthritis.

Mr. Kaydouh has substantial experience in this area and as such will adequately gather all the necessary records pertaining to the fall in question, as well as your medical records so as to provide an adequate settlement package to the insurance company and/or jury if necessary
